The judge said I wasn't responsible for the mortgage loan. The judge awarded it to my spouse. A divorce decree does not alter the contract with your lender or change the entry on your credit report. Although the judge may have ruled that your ex-spouse would be responsible for making payments on the mortgage, if you didn’t contact the lender and have them remove you from the contract, you are likely still responsible for the debt.
In most cases, removing your name from the loan is only possible if your ex-spouse is able to qualify to refinance the loan in his name only. In some cases an assumption of the loan may be possible, but he likely would still need to prove that he is able to repay the debt on his own.
If he is unable to qualify, the lender does not have to release you from the joint contract, and the mortgage account will remain on your credit report.
